There videos can be deleted if it has copyrighted material. They play by the same rules as everyone else. As long as you have some actually proof, you can have your content taken off their channel. I don't know how long YouTube will take though to review the evidence and such.

YT is required by law to remove or disable ANY video for which the copyright owners file a complaint. Whether they re-enable it after a counter-notification depends upon whether the copyright owners sue for a federal restraining order within two weeks or so. Of course, the copyright owners can also wait up to 3 years to see if the violators have anything worth taking away in an infringement lawsuit.

But YouTube does ask you provide proof of copyright if the user disputes the claim.

YouTube removes content when they receive complete and valid removal requests. Buy you will need to provide proof as the legitimate owner.
