my brother has put a video on youtube and my arm is in it can i sue?

Well Im 15 and my bro's 11 but he has this video and at one point you see my face because he was filming me and then my arms on it because i was next to him.

He has put this video on without asking and im in it and i don't want to be on youtube without permission. I have reported it for infringing my rights.

When i said to my parents to get him to take it off they said no its his choice and i don't dare ask him to take it off (he's weird and has come at me with a knife on more than one occasion)

Anyway Im wondering how I can get youtube to remove the video or will I have to get the police involved?

On what grounds would you be suing? In order to sue, you need to prove that you have attained some sort of damages.



Having your arm or face for that matter, appear on YouTube causes no damage. Especially if you can not be otherwise identified. Every time you walk into a store, your picture is being taken by security cameras. Every time you walk outside your house or go anywhere in public, any person has the right to take your picture without the need to ask your permission.



I went on vacation and took photos of thousands of complete strangers and put the photos online without getting their permission. They can't sue me.



If I wrote that you absolutely had the right to sue your brother (but I'm not)... what would you, as a 15 year old do? Would you hire a lawyer? Would you file papers against him? What?



Unless the video violates a YouTube guideline, they have no reason to remove the video. If you call the police... they'll all have a good laugh at your expense.

Ahh...an ethical question. Hey, it's good you're taking a moment to think about it and even ask. The best thing you can do is place yourself in that person's shoes. If you were inebriated and did some silly or even stupid things when you had little control over yourself, would you want someone to be posting anything of you on YouTube? You might say yes, and you might say no...but that video can always resurface later in your life and really make you look bad when you may need to look your best: prior to a job interview, up for promotion, politics, etc. Most likely you won't get sued. However, there may be grounds for a defamation suit if it really is that bad. My best advice? Just keep the video for you a couple buddies who were there to laugh about on your computer. Don't post it. Once you put it on the internet, you no longer have control of it, but still bear the responsibility since you were the one who filmed it.

Report the video, say you are in it without your permission and you would like it removed.

Youtube has very strict guidelines to their videos. and must abide by both US and International law reguarding copyrights...

you would not be able to sue because it was not used for commercial use, you can however try to contact youtube and have them take it off

Just get his username and password and delete it problem solved! and erase it from his PC to and from his SD card! so he cnt upload it again!
